Terms of Service

1. Acceptance of Terms

By accessing or using DPDPOne (“the Service”), operated by Mahadev Consultancy(“we”, “us”, or “our”), headquartered in Bengaluru, Karnataka, India, you agree to be bound by these Terms of Service.

If you do not agree to these terms, you must not access or use the Service. By creating an account or continuing to use the Service after any updates to these terms, you confirm your acceptance.

2. Description of Service

DPDPOne is a Software-as-a-Service (SaaS) platform designed to assist Indian organisations in understanding their compliance posture under the Digital Personal Data Protection Act, 2023 (“DPDP Act”). The Service includes:

• DPDP readiness gap assessments
• Compliance scoring and domain-level analysis
• Privacy notice and consent form generation
• Prioritised action plan reports
• Subscription-based access to advanced features

Important: DPDPOne is an informational and self-assessment tool, not legal advice. Assessment results are based solely on self-declared responses provided by your organisation. We make no guarantee that use of this Service constitutes or ensures actual legal compliance with the DPDP Act or any other law. You should seek qualified legal counsel for compliance decisions.

3. User Accounts and Registration

To access the full Service, you must create an account. You agree to:

• Provide accurate, complete, and current registration information
• Maintain the security of your password and account
• Notify us immediately of any unauthorised use at hello@dpdpone.com
• Accept responsibility for all activities under your account
• Not share your account credentials with others

You must be at least 18 years old and authorised to bind your organisation to these terms to create an account.

4. Subscription and Payment Terms

DPDPOne offers both free and paid subscription tiers. Paid subscriptions are billed monthly at the rates displayed at the time of purchase, exclusive of applicable GST.

• Payments are processed by Razorpay. We do not store your payment card details.
• Subscriptions auto-renew monthly unless cancelled before the renewal date.
• Refunds are not provided for partial months or unused features unless required by law.
• We reserve the right to change pricing with 30 days' notice to registered users.
• Failure to pay may result in downgrade to the Free tier.

4A. Refund and Cancellation Policy

4A.1 Cancellation

You may cancel your subscription at any time from your billing page or by writing to hello@dpdpone.com. Cancellation takes effect at the end of the current billing period.

4A.2 Refunds

Subscription fees are non-refundable except where required by applicable law. Access continues until the end of the paid billing period.

4A.3 Exceptional Circumstances

Refund requests due to verified technical failures will be considered on a case-by-case basis. Write to hello@dpdpone.com within 7 days of the charge.

4A.4 Data After Cancellation

Your data is retained for 30 days after cancellation and then permanently deleted unless earlier deletion is requested.

5. Acceptable Use Policy

You agree not to use the Service to:

• Violate any applicable Indian or international law
• Submit false or misleading compliance information
• Reverse-engineer, copy, or redistribute the platform or its outputs
• Attempt to gain unauthorised access to other users' accounts or data
• Use automated bots or scraping tools against the platform
• Resell or sublicense the Service without written permission
• Upload malicious code or interfere with platform security

6. Intellectual Property

All content, features, design, algorithms, and methodology of the DPDPOne platform are owned by Mahadev Consultancy and protected by applicable intellectual property laws.

You retain ownership of the data you input into the Service. You grant us a limited licence to process your data solely for the purpose of providing the Service to you.

Assessment reports and generated notices are provided for your internal use only. You may not publicly represent them as legal opinions or certifications of compliance.

7. Data Privacy and Security

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We process all data exclusively within India (AWS ap-south-1, Mumbai region) in accordance with the DPDP Act, 2023.

8. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that: (a) the Service will be uninterrupted or error-free; (b) assessment results accurately reflect your legal compliance status; (c) generated notices are legally sufficient for your specific circumstances.

9. Limitation of Liability

To the maximum extent permitted by applicable Indian law, Mahadev Consultancy shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

Our total aggregate liability to you for any claims arising from use of the Service shall not exceed the total amount paid by you to us in the three (3) calendar months immediately preceding the event giving rise to the claim.

This limitation applies even if we have been advised of the possibility of such damages.

10. Indemnification

You agree to indemnify and hold harmless Mahadev Consultancy, its principals, employees, and agents from any claims, losses, damages, or expenses (including legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of any third-party rights.

11. Termination

Either party may terminate the service relationship at any time. You may cancel your account from within the dashboard or by emailing hello@dpdpone.com. We may suspend or terminate your access immediately if you breach these Terms.

Upon termination, your right to use the Service ceases immediately. We will retain your data in accordance with our Privacy Policy and applicable legal obligations.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising shall be subject to the exclusive jurisdiction of the courts of Bengaluru, Karnataka, India.

Nothing in these Terms limits your rights under applicable consumer protection laws in India.

13. Changes to Terms

We reserve the right to update these Terms at any time. Material changes will be communicated to registered users via email at least 14 days before they take effect. Continued use of the Service after changes constitutes acceptance of the revised Terms. The latest version is always available at dpdpone.com/terms-of-service.
